By Literature surveying, the writer found that both Neocalamites rugostis Sze and Equise ntes asperrimus Franke are synonymum. The former was created by Sze ( 1956) for specimens of plant fossils collected from that Yenchang Formation (Upper Triassic) in the North Shensi of China, and the latter was named by Frankc (1936) for the Keuper plant fossils obtained from the Thale, Northern Harz, Mountains of Germany. The specific name used by Franke should be conserved based on the grounds of priority, but the gencric name might be transferred to the genus Neocalamites because there were no other classifiable features, such as the fertile organ, leaf-sheath and nodal diaphragm, ate known in the Harz material. The generic determination of Sze’s is valid, but the specific name is a later synonymum of Franke’s and is therefore illegimate. So the both can be combinaled and the writer named them here Newalumites asperrimus(Franke) Shen, comb. nov.
